Terms and conditions
General terms and conditions for MarvinMC Hosting and its web panel. Version: 2026-09-26.
Section 1 Scope
These terms apply to use of the web panel and to hosting services offered by Marvin Leonhardt under the name MarvinMC Hosting. A consumer is a natural person acting mainly outside their trade or independent professional activity. An entrepreneur acts in the course of their trade or independent professional activity.
Individual agreements and mandatory law take precedence. Customer terms apply only if expressly confirmed in text form.
Section 2 Contract and contract text
Tariff and option displays are a non-binding invitation to submit an offer. The customer submits a binding offer by sending the relevant order. Acceptance takes place by express confirmation or by making the booked service available. The selected tariff, resources, term and price are shown in the order and the subsequent panel display.
The terms and order data can be accessed before submission. The customer should save them. Statutory confirmation and information duties remain unaffected.
Section 3 Account and credentials
A personal account is required for protected features. Information must be accurate and current. Credentials must be kept secret and suspected misuse must be reported without delay. Accounts may not be sold or permanently transferred without consent.
Consent to this terms version is documented during registration and before a server order. The email address must be confirmed before protected member features can be used. An unverified new registration is deleted automatically after 30 days unless statutory retention or evidentiary duties require otherwise.
Section 4 Services
Depending on the booked offer, MarvinMC Hosting provides manageable Minecraft and other server environments including a web panel, console, file and folder management, FTPS, databases, backups, subdomains, resources, ports and optional automations. Availability depends on the plan, server type, node, technical requirements and the panel display.
Additional IPs, ports, databases and backup storage are available only where activated and paid for in the relevant offer. Minecraft servers are also subject to the license and usage terms of the relevant rights holders, including the Minecraft EULA.
Section 5 Availability, maintenance and changes
Continuous availability or a specific response time is owed only where expressly agreed as a service level. Maintenance, security measures, overload, provider outages, force majeure and necessary interventions may affect availability. Planned maintenance will be announced in advance where possible.
MarvinMC Hosting may technically develop services and make security or feature changes. Material changes to the scope of service will be announced with reasonable notice where reasonable and legally required.
Section 6 Prices and payment
The prices, billing periods and service limits shown before ordering apply. Prices are shown in euros. The applicable tax treatment follows the invoice and the provider’s current tax status. Under the current system status, the German small-business exemption under Section 19 UStG is applied and VAT is not shown separately; the display will be updated if the status changes.
PayPal, Stripe and PaysafeCard may be offered depending on activation. The payment provider may apply additional terms and fees.
Section 7 Balance and credits
Top-ups are credited to the customer account only after successful payment confirmation. A payment confirmation is issued for the top-up; it is not an invoice for a hosting service. Hosting services actually rendered are summarized in a monthly service invoice after the end of each calendar month. Balance may be used only for hosting services offered in the panel and does not earn interest. Bonus or administrative credits may be subject to separate expiry or offset rules.
Refunds, cancellations and corrections follow statutory law, payment conditions and the service status. A payout of unused balance is owed only where required by law or expressly promised.
Section 8 Server term, extension and expiry
Servers are paid in advance from available balance for the term selected during ordering. The term generally begins when the server is made available or on the start date shown in the panel. There is no automatic renewal unless expressly offered and agreed. Extensions and chargeable resource changes are performed only when sufficient balance is available.
After expiry, a server may be restricted, archived and deleted after the retention period shown in the panel or technical procedures. The customer must back up data before expiry.
Section 9 Customer obligations
Customers must comply with laws, third-party rights, these terms, the Minecraft EULA and the rules of payment and integration services used. They must administer their servers, plugins, mods, credentials and content and install security updates.
Prohibited uses include copyright or trademark infringement, fraud, phishing, spam, malware, DDoS or other attacks, scanning, unauthorised mining, botnets, trading stolen credentials, child sexual abuse material, terrorist content and other unlawful or security-threatening use.
Section 10 Content, rights and moderation
The customer remains responsible for all content stored, transmitted or published by the customer or their users and must hold the required rights. The customer grants MarvinMC Hosting only the rights technically required to store, transmit, secure and process content for service delivery.
There is no general monitoring obligation. Where there are specific indications of illegal content, terms violations or security risks, content or services may be reviewed, removed, restricted or disclosed to competent bodies in accordance with the law.
Section 11 Security and abuse
The customer must use secure passwords, grant access only to authorised persons and promptly disable or report compromised access. Shared server access and Discord connections may be granted only to persons entitled to receive them.
The customer is liable for culpable violations within their area of responsibility and must indemnify MarvinMC Hosting against justified third-party claims where the customer is responsible for the infringement. Statutory claims remain unaffected.
Section 12 Backups and data loss
Backups and additional backup storage are technical features and do not replace independent backups. Backup intervals, retention, storage limits and restoration depend on the relevant plan and panel display. The customer must additionally secure important data outside the service.
Section 13 Suspension and termination
In the event of late payment, expiry, breaches of these terms, specific infringement notices or risks to systems and third parties, individual features, servers or accounts may be restricted or suspended proportionately. In cases of immediate danger or legal obligation this may occur without prior notice. Reasons and next steps will be communicated where possible.
The right to terminate for good cause remains. Account closure may be requested through available features or by email; statutory retention duties remain.
Section 14 Notices of illegal content
Notices concerning allegedly illegal content should be sent electronically to support@marvinmc.net. A notice should include the exact URL or server path, a sufficiently reasoned explanation, the notifier’s name and email address and a statement that the information is accurate. Statutory exceptions may apply to specially protected notices.
Notices are handled carefully, objectively and proportionately. Affected customers receive reasons and may respond where legally required.
Section 15 Liability
Marvin Leonhardt is liable without limitation for damage caused intentionally or by gross negligence, injury to life, body or health, under the Product Liability Act and in cases of an expressly assumed guarantee. In cases of ordinary negligence, liability applies only for breach of essential contractual duties and is limited to foreseeable, typically occurring damage.
These limitations do not apply where mandatory law prevents them. Liability for data loss is not excluded generally; it depends on statutory requirements and the extent of proper independent backups.
Section 16 Consumer withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. Details are governed by the separate withdrawal information and statutory law.
If a consumer expressly requests that the service begin before the withdrawal period ends, the consumer will be informed of the consequences. The right may expire after complete performance under statutory conditions. Compensation for services already provided may be owed under statutory law.
Withdrawal may be declared clearly by email to support@marvinmc.net. The statutory model withdrawal form may be used but is not mandatory.
Section 17 Changes to these terms
Changes to these terms are communicated in text form. Changes to ongoing contracts take effect only if the customer agrees or a legally permitted change mechanism applies. Consent is in particular required where a change affects the main service, price or essential customer rights.
Section 18 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless this would deprive consumers of mandatory protection in their country of habitual residence. Exclusive jurisdiction clauses may be agreed with consumers only to the extent permitted by law.
If a provision is or becomes invalid, the remaining provisions remain effective. The statutory provision replaces the invalid provision.
